ELIGIBILITY. Subject to the additional restrictions below, the Xplore's Best Outdoor Photo Sweepstakes (the "Sweepstakes ") is open to U.S. Residents (excluding Puerto Rico) who are 18 years or older at the time of entry. Employees and contractors of Fort Collins Coloradoan, Gannett Co., Inc., the Windsor Beacon, and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees or contractors, are not eligible or win.
HOW TO ENTER. The Sweepstakes will run continuously beginning at 8:00 am (MT) November 1, 2015 and ending 5 p.m. October 31, 2016 (the “Sweepstakes Period”). There will be one (1) winner every month selected by voting of the general public. To enter, visit Coloradoan.com/Xplore and follow the instructions to upload Outdoor photos such as wildlife, wildflowers, outdoor sports, landscapes, weather and scenics taken in Colorado in that specific month. Complete all required information and follow posting instructions. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Ad blocking software on your computer needs to be disabled so that it doesn’t interfere with processing your entry. Entries must be received by 5 p.m. (M.T.) on the 21st day of each month to be included in the voting for that month. Each photo submission must be an authentic, original photograph taken by entrant identified on the accompanying entry form, and the entrant must own the copyright in the photograph submitted. Submitting the Photo and entry serves as a release and permission for Sponsor to post entrant’s first name and Photo on Sponsor’s website. Sponsor will accept photos in black and white or color. All digital entries should be at the highest resolution possible. Sponsor will accept the photo formats of jpeg. Photos should be cropped as the entrant prefers. Entrant confirms that he/she received permission from the any person featured in the Photo for submission in the Sweepstakes, and for Sponsor to post the Photo on its websites and in the Coloradoan. Sponsor reserves the right to refuse any photograph they determine to be unacceptable. Photo submissions are unlimited per person, for each month’s Sweepstakes. One prize will be awarded per person per month during the Sweepstakes Period. By entering, you agree to the terms of these Official Rules and to receive e-mails from Sponsor or those directed by Sponsor. You can opt-out of the receipt of such e-mails by following the directions in any email received from Sponsor.
Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify any entry that is alleged to infringe on any third-party’s intellectual property rights, or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience.
VOTING PERIODS: All Photos will be voted on by the public on Coloradoan.com. Voting for Xplore's Best Photo will begin at 8 a.m. (M.T.) the 22nd of each month and end at 5:00 p.m. (M.T.) on the 29th of each month. Go to Coloradoan.com/Xplore, and submit your vote for your favorite photo. You may vote for more than one photo. Voting is open to anyone over the age of 13. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Ad blocking software on your computer needs to be disabled so that it doesn’t interfere with processing your entry.
WINNER SELECTION: One (1) Monthly Winner will be selected each month based on the most eligible votes received. Monthly winners will be selected on or about the 30th of each month. In the event of a tie, winners will be selected by a random drawing from among tied entries.
PRIZES AND ODDS: There will be one (1) monthly winner each month for the duration of the Sweepstakes. One (1) monthly winner will receive a framed print of their winning photo, the publication of their photo and a Q&A with the winner in Xplore (ARV: $25). The prize must be claimed within 60 days from notification.
WINNER NOTIFICATION AND ACCEPTANCE. Winners will be notified on or about the 30th of each month during the Sweepstakes Period during regular business hours at the email address provided on the online Official Entry form. Each winner must respond to such notification within 48 hours. Failure to respond in such time period or return of email prize notification as undeliverable may result in the disqualification of winner, forfeiture of his or her interest in the prize, and selection of a substitute winner. To claim prize, winner must personally visit the Fort Collins Coloradoan, 1300 Riverside Ave. during regular business hours and valid photo identification may be required. Prize must be collected within 30 day after notification or all interest in prize will be forfeited. Winners may waive their right to receive prizes. No substitutions allowed by winners. Prizes are not redeemable for cash. Prizes and individual components of prize packages are subject to availability and Sponsor reserve the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility/liability and publicity release. Failure to sign and return the affidavit of release, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name and likeness in any media for commercial or promotional purposes. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
PARTICIPATION. By participating, entrants agree to be bound by the complete Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes as solely determined by Sponsor. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, firmness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
COPYRIGHT. By entering the Sweepstakes, each entrant grants to Sponsor a royalty-free, limited license to publish, print, edit or otherwise use the submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world, without compensation. Each entrant further agrees that if his/her entry is selected by Sponsor as the winning entry, he/she may be asked to sign any additional license or release that Sponsor may require.
CONSTRUCTION. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was or contained therein.
SPONSOR. The Xplore's Best Outdoor Photo Sweepstakes is sponsored by the Fort Collins Coloradoan. The decisions of Sponsor regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in the Official Rules or in other materials relating to the Sweepstakes.
